REIMBURSEMENT OF LOST WAGES Lost wages are recoverable as past, present and future lost wages.
REIMBURSEMENT FOR MEDICAL COST Medical cost include past, present and future medical cost. Often times (depending whether your case is filed in the circuit court or the district court) a medical expert is required to prove the medical cost portion of your damages. As such your expert must prove the cost are fair, reasonable, necessary and causally connected to the injury arising from the accident. These damages must be proven with reasonable certainty and can not be speculative. The need for future medical care must be proven with evidence that the future care is not less then fifty percent likely to be needed in the future Pierce v Johns-Manville Sales Corp 464 A2d 1020 (1983). |
