What you need to know about Maryland Personal Injury

At the scene of a car accident it is important to remember to gather information about the car accident if you are able. For many of our clients this is not always possible due to the nature and extent of the accident and personal injury. At a minimum be alert to the other driver's identification information. A car license tag number can mean all the difference. Be aware of potential witnesses. Names, addresses and telephone numbers can be the missing link to vital information. In most cases the police will arrive at the traffic accident and the officer will secure information about the car accident that will be important later. However, if you are able, do not leave your case to chance. Next seek medical attention if required. DO NOT speak to the other drivers insurance company. You MUST speak to a Maryland personal injury lawyer or your family attorney first. Believe me when I tell you. The insurance company is not there to help you. Get a Maryland Injury Attorney on your side first. Call for a free phone consultation 1-888-760-7339.

Contact A Maryland Personal Injury Lawyer

It is very important you make contact with a Maryland Personal Injury Lawyer promptly after your accident. You want to be sure your rights to recover damages are not adversely affected by the insurance company investigator who will certainly be calling for a statement with in the 24 hours after the accident. I can tell you now, when those adjustors call, (1) they are not calling to help or because they are concerned about you or your injury and (2) they are simply gathering evidence against you to use against you at trial. The only smart decision to make when the opposing driver's insurance company calls is to hang up or refer them to your attorney.

WHAT HAPPENS AFTER YOU RETAIN MY OFFICE AS YOUR ATTORNEY

I am sure every law office has variation on how they perform their responsibility to their clients. My procedure, and please do appreciate that many of these steps all happen simultaneously, is as follows:

1. We open the Case Control Programs to calendar your statute of limitations for (1) the personal injury protection insurance limitations and (2) the personal injury limitation for filing suit.

2. We clearly identify the defendant driver to insure we do not have any additional notice requirements to follow. For example, if your accident involved a driver who is working for the government, city, or county you could have additional notice requirements that if not followed would bar your case.

3. We make sure you have your doctors appointment arraigned so you can receive prompt and competent medical attention.

4. We forward letters to each insurance carrier involved in the accident and order the police, ambulance, and fire department records.

5. We forward witness information to our private investigator to secure recorded statements from any and all witnesses.

6. We make direct contact with your insurance company to secure, complete, and file the personal injury protection forms.

7. We then contact both your insurance company and the other drivers insurance company regarding the property damage and the need for a rental car.

8. From this point forward the majority of the work is monitoring your progress through treatment and gathering your Specials which include information on medical cost, lost wages, prescriptions, and mileage.

9. Once you have completed treatment or in more serious cases, when treatment has reach its maximum benefit we reassess the case for a damages appraisal. This procedure includes meeting with our medical advisors, discussing with you our clients what we believe is a reasonable settlement value to compensate you for your damages.

10. We forward our demand package to the insurance company and calendar a follow up call to verify they have received the demand. Thereafter we calendar 3 weeks after confirmation and we call the insurance adjustor to discuss settlement.
